The queer individual and Labor Justice: A case study on homophobia and bias in legal sentence

The quest for equality and the assurance of rights for individuals with non-heteronormative sexual orientations continue to face significant challenges. In addition to the frequent social, psychological, and physical violence that affect this group, it is particularly concerning when such abuses are committed by members of institutions whose aim is combating these practices. This case study examines an incident of violence that occurred in the workplace, and, when brought before the court, was treated with indifference. This was due to the judge’s statement in which he claimed that ‘for those who believe homosexuality is a legitimate inclination, being called homosexual or ‘faggot’ should be as offensive as being called heterosexual or ‘macho’; is for those who define their sexuality in accordance with their own physical attributes’.
