The protection of mothers of children with disabilities in the labor market and the application of the Protocol for Trial with a Gender Perspective of the National Council of Justice

Motherhood is still one of the main causes of inequality, discrimination, and asymmetry for women in the labor market and, for mothers of children with disabilities, accessing and remaining in paid work can be even more difficult, considering the great demand for care that These kids need it. In this context, the article under discussion aims to carry out, through a bibliographical review relating to the theme of unpaid maternal care work, as well as consultation of legislative sources, international documents and quantitative data, an analysis of the application of the Protocol for Judgment with Gender Perspective of the National Council of Justice, as an important mechanism to ensure the protection of mothers of children with disabilities in the labor market. From the information gathered, it was possible to observe how justice, through a gender perspective, can observe the reality of the worker responsible for children with disabilities, in order not to make invisible and ignore the structural oppressions and unequal relationships marked by the sexual division of the existing work in our society and, therefore, enable the effectiveness of the rights of these workers.
